SUBSCRIPTION AGREEMENT TERMS AND CONDITIONS

This service is provided by the Clerk & Comptroller, in and for Palm Beach County, Florida (hereinafter referred to as "Clerk") as a public service. This service is currently available without charge to the User, however the Clerk reserves the right to charge a reasonable fee for use of the service as required and based upon costs for delivery and maintenance of the service. These terms and conditions of use are subject to change without notice.

This web site is intended for the private use of the public for general informational purposes only. The information available through this web site is not the official court record information of the Clerk, and should not be relied upon for any type of legal action. The official court record information is available only from the Clerk & Comptroller’s office.

The User is expressly prohibited from reproducing, publishing on-line, selling, reselling or otherwise disseminating data or information accessed pursuant to this service. The information accessed is not intended or permitted to be used for commercial resale.

User understands and acknowledges that court data and record changes are made on a continuing basis. Case data may be subject, at any time during the proceedings or after the conclusion of the case, to a court order that changes data from public to non-public. User assumes sole responsibility for the use and dissemination of case data obtained from this service and agrees to hold Clerk harmless from any claims or demands pertaining to user’s dissemination or use of case data.

The information provided through this service is extracted from the Clerk's electronic records databases and is not the official records of the Clerk. The information presented on this site is generally updated on a daily basis but events may occur that delay the data updates and/or this service’s availability. Therefore, the information available through this service is not warranted to be accurate, complete or current. The Clerk makes no representations or guarantees regarding availability of this service.

User accepts all risks of using this electronic service. The User is responsible for the appropriate use, maintenance and control of the user access code associated with the use of this site.

Unauthorized access, utilization, disclosure or modification of data or any alteration of any component of this site is expressly prohibited and is punishable as provided by law. Unauthorized attempts to upload or change information on this service are strictly prohibited and may be punishable under any and all applicable laws.

Without waiving any other defenses or immunities provided by law, the Clerk shall not be liable for any demand or claim, regardless of form of action, arising out of or incident to the accessing or use of any information or data on this service, and/or the acts or omissions of any person or entity accessing or using any information from this service. This includes, but is not limited to, claims arising out of or incident to incorrect or incomplete data or data that has not been updated. By accessing information provided on this site, the user expressly agrees to indemnify and hold the Clerk harmless for any loss, cost, damage or expense arising directly or indirectly in connection with such access or any damage suffered by the user or any third party relying on said accessed information.

All users are advised to independently verify any information or data obtained herein with the official court record information reposing in the court files. User agrees that the services are provided "as is"; the clerk makes no representation or warranty with respect to accuracy, completeness, or correctness; and Clerk specifically disclaims any other warranty, express, implied or statutory, including any warranty of merchantability or fitness for a particular purpose. Neither the clerk, its elected officials, officers, employees or agents, expressly or impliedly warrant that the information or data accessed by user is accurate or correct. There are no expressed or implied warranties in connection with this service. They shall not be liable on account of any such errors, omissions, delays, or losses.

User agrees that in no event will Clerk be liable for the results of user's use of the services, inability or failure to conduct its business, or for indirect, special or consequential damages. The foregoing limitation of liability and exclusion of certain damages shall apply regardless of the success or effectiveness of other remedies.

User hereby relieves and releases Clerk and its third party providers from liability and from any and all damages resulting from interrupted service of any kind.

Nothing in this agreement shall be construed as waiving the sovereign immunity of Clerk, its third party providers, their officers, employees and agents.

The Clerk provides no warranties of any kind or nature, express or implied, and specifically disclaims any and all warranties of any kind or nature, express or implied, and specifically disclaims any and all warranties with regard to any computer programs, data, materials or services in connection with this web service. The Clerk diligently strives to maintain accurate, complete and timely data on this service but shall not be liable for any consequential, exemplary, incidental or special damages arising from or in connection with data or information accessed via this site.

Due to the limited capacity available for this advance deployment of the EZ-View service, unattended connections will be terminated after 15 minutes of inactivity and access to the service may be delayed during peak periods of activity. Also, only one simultaneous connection may be established per user ID.

For system security purposes, users will only be allowed three attempts to log in to the system before their connection will be locked. Additionally, passwords expire every ninety days and must be replaced.

Please be advised that not all purged criminal history records are available through the system at this time.
